Gardeners Bromley Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Bromley provides gardening and related services to domestic and commercial customers. By booking or receiving any service from Gardeners Bromley, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not place a booking or allow work to proceed.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, company, or organisation that books or receives services from Gardeners Bromley.

Services means any gardening, garden maintenance, lawn care, hedge cutting, tree and shrub work, clearance, planting, soft landscaping, or related work carried out by Gardeners Bromley.

Visit means each occasion that Gardeners Bromley attends the property to provide Services, whether as a one-off or part of an ongoing schedule.

Property means the garden, outdoor area, grounds, or other location where the Services are to be provided.

2. Scope of Services

Gardeners Bromley offers general gardening and garden maintenance services, which may include lawn mowing, strimming, weeding, pruning, hedge trimming, planting, garden clearance, seasonal tidy-ups, soft landscaping, and similar tasks. The specific work to be carried out at a Visit will be agreed with the Customer in advance, either as a one-off job or as part of a regular maintenance plan.

Any description of Services provided in written quotes, verbal discussions, or other communications is given as a general guide only. Gardeners Bromley reserves the right to reasonably vary the exact method or sequence of work to achieve the agreed outcome, provided that such variation does not materially reduce the quality or scope of the Services.

3. Booking Process

All bookings must be made directly with Gardeners Bromley. Bookings may be requested by the Customer and will be confirmed by Gardeners Bromley once all required information has been provided and an appointment date and time have been agreed.

When making a booking, the Customer must provide accurate information about the Property, including size of the garden or area to be serviced, access arrangements, parking availability, and any known hazards. If the information supplied is incomplete or inaccurate, Gardeners Bromley may adjust the quote or cancel the booking.

Quotations may be provided based on a description of the work or following a site visit. All quotations are valid for a limited period as stated at the time of issue. Acceptance of a quotation constitutes acceptance of these Terms and Conditions.

Regular maintenance visits may be booked on a recurring schedule. The Customer is responsible for informing Gardeners Bromley in advance if any scheduled Visit needs to be changed or cancelled, in accordance with the cancellation terms set out below.

4. Access and Parking

The Customer must ensure safe and reasonable access to the Property on the agreed date and time. This includes providing any necessary keys, codes, or entry instructions in advance, and ensuring that gates or passageways are unlocked and usable.

Where parking restrictions apply, the Customer is responsible for arranging suitable parking or providing any permits required. If free or suitable parking cannot be provided, Gardeners Bromley reserves the right to recharge any parking fees or penalties incurred in connection with the Visit.

If access is not available, is unsafe, or is significantly restricted on arrival, Gardeners Bromley may cancel or postpone the Visit and may charge a missed appointment or call-out fee to cover time and travel costs.

5. Customer Responsibilities

The Customer agrees to:

Ensure that the Property is reasonably clear of obstacles, animal waste, and personal items that would prevent or delay work.

Inform Gardeners Bromley in advance of any issues that may affect the Services, including underground utilities, fragile surfaces, ponds, special plants, or areas that must not be disturbed.

Keep children, pets, and other individuals away from the immediate working area while the Services are being carried out, to ensure health and safety.

Obtain any necessary permissions, approvals, or consents from landlords, neighbours, or local authorities where required for the Services, including but not limited to tree works or alterations affecting boundaries.

Advise Gardeners Bromley of any allergies or sensitivities that may be affected by the use of garden products such as fertilisers or weed treatments.

6. Pricing and Quotations

Prices for Services may be provided as a fixed quote for the job or as an hourly or daily rate. The basis on which pricing is calculated will be made clear to the Customer at the time of booking.

Quotes are based on the information available at the time. If, on arrival, the actual condition or size of the garden, volume of waste, or level of work required is materially different from what was described or observed when the quote was provided, Gardeners Bromley may revise the price. Any change to the price will be agreed with the Customer before proceeding, where possible.

If additional work is requested by the Customer during a Visit that was not included in the original quote or schedule, Gardeners Bromley may charge extra at the prevailing rates and will seek to agree these charges with the Customer in advance.

7. Payments and Invoices

Payment terms will be communicated to the Customer at the time of booking or quotation. Gardeners Bromley may require payment on the day of the Visit, in advance, or within a specified period after the invoice date.

Payment methods accepted will be confirmed directly with the Customer. The Customer must pay all invoices in full and on time. If payment is not received by the due date, Gardeners Bromley may suspend further work and may apply reasonable late payment charges or interest in accordance with applicable law.

For ongoing maintenance contracts, Gardeners Bromley may issue regular invoices according to the agreed schedule. Failure to pay for one or more Visits may result in the suspension or termination of the maintenance arrangement.

8. Cancellations and Rescheduling

The Customer may cancel or reschedule a Visit by giving notice to Gardeners Bromley. Unless otherwise agreed, at least 24 hours notice is required for cancellation or rescheduling of standard maintenance Visits, and at least 48 hours notice for larger one-off projects.

If the Customer cancels or reschedules with less notice than required, or if Gardeners Bromley attends the Property and is unable to gain access, Gardeners Bromley may charge a cancellation or call-out fee to contribute towards lost time and travel costs.

Gardeners Bromley may need to cancel or reschedule a Visit due to severe weather conditions, illness, vehicle breakdown, or other circumstances beyond its reasonable control. In such cases, Gardeners Bromley will seek to notify the Customer as soon as practicable and will arrange an alternative date. Gardeners Bromley will not be liable for any loss arising from such cancellations or delays, provided that reasonable efforts are made to reschedule.

9. Weather and Seasonal Conditions

Certain gardening tasks are dependent on weather and seasonal conditions. Gardeners Bromley reserves the right to refuse or postpone work that cannot safely or sensibly be carried out due to heavy rain, high winds, frost, drought, or other adverse conditions. Some treatments and planting may be rescheduled if conditions would compromise the quality or survival of the plants or work.

During extreme weather events, scheduled Visits may be rearranged at short notice. Gardeners Bromley will aim to communicate any changes promptly and will work with the Customer to find a suitable alternative time.

10. Garden Waste and Waste Regulations

Garden waste includes grass cuttings, leaves, branches, hedge clippings, plants, and other organic material arising from the Services. Gardeners Bromley will comply with relevant waste disposal laws and regulations when removing waste from the Property.

Whether garden waste removal is included in the quoted price will be made clear at the time of booking. In some cases, the quote may cover cutting and stacking waste neatly on site, leaving disposal to the Customer. In other cases, Gardeners Bromley may remove and dispose of waste for an additional charge, which will reflect disposal costs and labour.

Gardeners Bromley is not responsible for the disposal of non-garden waste such as rubble, building materials, household rubbish, or hazardous substances unless expressly agreed in writing as part of the Service. If significant quantities of non-garden waste are discovered at the Property, Gardeners Bromley may refuse to remove them and may adjust the quote or charges to reflect any additional time spent dealing with such materials.

Where the Customer requests that waste is left on site for composting or other use, Gardeners Bromley will not be responsible for any subsequent issues arising from the storage or decomposition of that waste.

11. Use of Products and Materials

Gardeners Bromley may use tools, equipment, and garden products such as fertilisers, soil improvers, weed control products, and pest treatments as part of the Services. Products will be selected with reasonable care and in line with industry practice.

If the Customer wishes to supply their own materials or products, any use of those materials is at the Customer's own risk. Gardeners Bromley will not be liable for defects or failures arising from products supplied by the Customer, or for delays caused by shortages or unsuitable materials provided by the Customer.

Tree work and the use of certain chemicals may be subject to additional legal controls. Gardeners Bromley will only undertake such work in accordance with relevant regulations and may decline requests that would breach legal or safety standards.

12. Liability and Limitations

Gardeners Bromley will perform the Services with reasonable skill and care. If the Customer believes that any Service has not been carried out to a reasonable standard, the Customer must notify Gardeners Bromley promptly, providing details and allowing a reasonable opportunity for inspection and, where appropriate, rectification.

Gardeners Bromley is not liable for:

Pre-existing damage, disease, or defects in plants, lawns, trees, structures, or surfaces, or for deterioration that occurs due to age, underlying conditions, or events outside Gardeners Bromley's control.

Damage or loss arising from inaccurate information supplied by the Customer, including the presence of underground utilities, cables, or pipes not disclosed in advance.

Indirect or consequential loss, loss of enjoyment, loss of profits, or loss of value of the Property, except where such loss cannot be excluded by law.

The total liability of Gardeners Bromley for any claim arising out of the provision of Services, whether in contract, tort, or otherwise, shall not exceed the total amount paid or payable by the Customer for the specific Visit or job during which the issue arose, unless a higher amount is required by law.

13. Health and Safety

Gardeners Bromley will take reasonable steps to ensure that all work is carried out safely, in line with applicable health and safety requirements. The Customer agrees to cooperate in maintaining a safe working environment, including keeping pets and children away from tools and machinery and following any safety advice provided.

Gardeners Bromley may decline to carry out work that it considers unsafe, such as work at height without suitable access, work near unstable structures, or work involving hazardous materials. Where possible, alternative approaches will be discussed with the Customer.

14. Complaints and Dispute Resolution

If the Customer has any concerns about the Services, they should raise them with Gardeners Bromley as soon as possible. Gardeners Bromley will aim to resolve issues promptly and fairly, which may involve revisiting the Property to review the work, offering advice, or carrying out reasonable remedial work where appropriate.

Where a dispute cannot be resolved directly, the parties may consider using mediation or another form of alternative dispute resolution before taking legal action. This does not affect the right of either party to bring a claim in the courts where necessary.

15. Changes to Terms and Conditions

Gardeners Bromley may update these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking. Customers are encouraged to review the Terms and Conditions periodically to stay informed about any changes that may affect future Services.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the provision of Services by Gardeners Bromley, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, subject to any mandatory rights the Customer may have under applicable consumer protection laws.

17. Severability

If any provision or part-provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the remaining provisions shall not be affected.

18. Entire Agreement

These Terms and Conditions, together with any written quotation or other written agreement provided by Gardeners Bromley, constitute the entire agreement between Gardeners Bromley and the Customer in relation to the Services. No other terms, whether implied by trade, custom, practice, or course of dealing, shall apply except where required by law.
